These Terms and Conditions govern your use of the AgencyFlow platform, operated by Christoph Perkles, sole proprietor, Grillparzerstraße 4, 5020 Salzburg, Austria, VAT ID ATU72203206 (hereinafter "we" or "provider"). By registering for and using AgencyFlow, you agree to these terms.
Using AgencyFlow requires creating a user account. You are responsible for providing accurate information during registration, keeping your login credentials confidential, and all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
AgencyFlow is offered as a monthly subscription at €29/month. Every new account receives a 7-day free trial. After the trial period, the subscription renews automatically unless you cancel before the trial ends. Price changes will be announced at least 30 days in advance.
Payments are processed via Stripe. All prices are exclusive of applicable value-added tax (EU VAT). Billing occurs monthly at the time of your subscription renewal. In case of failed payments, we reserve the right to restrict access after a reasonable grace period.
We take the protection of your data seriously. For details on how we process your personal data, please refer to our Privacy Policy.
Consumers within the meaning of the Austrian Consumer Protection Act (KSchG) have the right under the Distance and Off-Premises Transactions Act (FAGG) to withdraw from this contract within 14 days of conclusion without giving any reason. To exercise this right, an unambiguous statement by email to perkles@me.com is sufficient. Note: If you expressly request the immediate commencement of service (e.g. immediate account activation), your right of withdrawal expires once the contract has been fully performed. If you withdraw during ongoing performance, a pro-rata amount for the period already used will be charged.
The statutory warranty provisions under Austrian law apply. As AgencyFlow is provided as Software-as-a-Service (SaaS), we aim for an average annual availability of 99 % (excluding scheduled maintenance windows and outages of third-party providers such as Supabase, Stripe or Vercel). Features are continuously developed; individual features may be added, changed or removed.
You may cancel your subscription at any time through your account settings. After cancellation, you retain access until the end of your paid billing period. You then have 30 days to export your data. After that, your data will be deleted in accordance with our Privacy Policy.
AgencyFlow is provided "as is." To the fullest extent permitted by law, we shall not be liable for indirect damages, lost profits, data loss, or business interruption. Our total liability is limited to the subscription fees you have paid in the last 12 months. This does not apply to damages caused by intent or gross negligence.
All rights to the AgencyFlow platform, including software, design, trademarks, and content, remain with Christoph Perkles. Use of the platform does not grant you ownership of any intellectual property. Your data stored in AgencyFlow remains your property.
We reserve the right to modify these Terms and Conditions. Material changes will be announced at least 30 days before taking effect via email. Continued use after changes take effect constitutes acceptance.
These Terms and Conditions are governed by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and the conflict-of-laws rules of private international law. For disputes with entrepreneurs, the competent court in Salzburg, Austria shall have exclusive jurisdiction. Mandatory consumer protection jurisdiction rules under Austrian law remain unaffected.
Consumers may use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
Should individual provisions of these Terms be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the applicable statutory regulation.
